By purchasing or using web hosting services from Clever Thinking Technologies, you confirm that you have read, understood, and agree to be legally bound by these Terms and Conditions.

These Terms apply only to web hosting services and do not include website maintenance, care plans, updates, monitoring, optimisation, other services or support unless expressly agreed in writing under a separate service agreement or Care Plan.

2. Nature of the Hosting Service

Clever Thinking Technologies provides hosting services through an established UK hosting infrastructure partner.

We act as a managed service reseller, facilitating access to hosting services and providing account administration and first-line assistance where applicable.

The hosting infrastructure, including servers, networks, hardware, operating systems, and data centre facilities, is operated by:

3. Scope of Hosting Services

Web hosting services may include, depending on the plan selected:

• Web server space
• Database access
• Email hosting
• Control panel access
• Network connectivity

Hosting services provide a platform for website files and data to be stored and accessed online. Hosting does not include website management, updates, performance optimisation, security hardening, troubleshooting, or monitoring unless separately contracted.

4. Client Responsibilities

You are solely responsible for:

• Managing website files, databases, and content
• Installing, updating, and maintaining software, including WordPress, plugins, and themes
• Ensuring compatibility of your website with the hosting environment
• Maintaining valid domain registration and DNS configuration
• Ensuring your website complies with applicable laws and regulations

Clever Thinking Technologies is not responsible for issues caused by misconfiguration, outdated software, insecure code, or unauthorised access.

5. No Maintenance or Support Included

Unless you have an active Website Maintenance and Care Plan or a separate written agreement, hosting services do not include:

• WordPress core, plugin, or theme updates
• Performance or speed optimisation
• Website monitoring or uptime tracking
• Malware removal or security remediation
• Troubleshooting broken websites
• Backup management or restoration

Any assistance outside basic hosting administration may be chargeable and subject to availability.

6. Third-Party Software and Code

Websites hosted under this agreement may rely on third-party software, including content management systems, plugins, themes, and scripts.

Clever Thinking Technologies is not responsible for:

• Malfunctioning, insecure, or defective third-party code
• Software incompatibilities
• Plugins or themes becoming unsupported or discontinued
• Security vulnerabilities introduced by third-party developers

Responsibility for third-party software rests entirely with the client.

7. Backups and Data Responsibility

Primary responsibility for website data, files, databases, and content rests with the client.

Backups may be provided by the hosting provider as part of the hosting service; however, Clever Thinking Technologies does not guarantee the availability, completeness, integrity, or recoverability of backups.

We are not liable for data loss, corrupted backups, or failed restorations. Clients are strongly advised to maintain independent, off-site backups and regularly verify backup integrity.

8. Service Availability and Downtime

No hosting provider can guarantee 100 percent uptime.

Service interruptions may occur due to, but not limited to:

• Server or network failures
• Maintenance windows
• Cyber security incidents
• Third-party service failures
• Force majeure events

Clever Thinking Technologies is not responsible for downtime caused by hosting infrastructure, network issues, or events outside our reasonable control.

9. Fair Use and Acceptable Use

Hosting services are provided subject to fair and acceptable use.

You must not use hosting services for activities that are unlawful, abusive, resource-intensive beyond reasonable limits, or in breach of the hosting provider’s acceptable use policies.

We reserve the right to suspend or terminate hosting services where usage is excessive, abusive, or non-compliant.

Traffic Levels, Resource Usage and Right to Upgrade

Hosting services are provided on a shared, managed infrastructure and are intended for normal business website usage. While reasonable fluctuations in traffic are expected, shared hosting environments have practical capacity limits and are not designed to support sustained or unusually high traffic volumes beyond their intended use.

If a website experiences a substantial increase in traffic, resource consumption, or activity which materially impacts server performance, stability, or the experience of other users on the platform, we reserve the right to take reasonable steps to protect the hosting environment. This may include, where appropriate, requesting that the client upgrades to a more suitable hosting solution.

Where reasonably practicable, we will aim to notify the client and discuss available options before any action is taken. However, we do not guarantee that shared hosting will be capable of supporting sudden, sustained, or abnormal traffic increases, viral exposure, automated activity, or other high-load scenarios.

Failure to upgrade where required may result in performance degradation, temporary service limitation, or suspension in order to maintain overall platform stability. Any upgrade, migration, optimisation, or additional work required as a result of increased traffic shall be chargeable unless expressly included within the client’s existing service plan.

Nothing in this clause guarantees website performance at any specific traffic level or removes the client’s responsibility to ensure their hosting solution remains appropriate for their website’s usage and growth.

10. Pricing and Billing

Hosting fees are charged as agreed at the time of purchase.

All prices are correct at the time of publication and may change with reasonable notice.

Failure to maintain payments may result in suspension or termination of hosting services.

11. Limitation of Liability

Clever Thinking Technologies shall not be liable for:

• Loss of revenue, profits, or business interruption
• Data loss or corruption
• Security breaches
• Downtime or service interruptions

Our total liability under this agreement shall not exceed the hosting fees paid by you in the preceding 12 months.

Nothing in these Terms limits liability where it would be unlawful to do so under UK law.

12. Termination

Either party may terminate hosting services with written notice. Fees remain payable up to the termination date.

We reserve the right to suspend or terminate services immediately where these Terms are breached or where continued service poses technical or legal risk.

13. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.

By purchasing or continuing to use web hosting services from Clever Thinking Technologies, you confirm your acceptance of these Terms and Conditions.

These Terms and Conditions constitute the legally binding agreement between you and us.
